After analyzing the Case, I have identified the moral issues at stake as being whether or not the judge was right for ordering the mother not to be able to smoke around her son. Since the normative thought process would be for the court to stay out of personal decision making, like a parent being able to smoke around their children. With this case I believe we are also dealing with a claim right which may have started off as a liberty right till it was taken away by the judge. I also believe we are dealing with a moral prescriptive claim because the mother should not smoke around her child and now she has an obligation and duty not to do so not only because is mom but also because of the judge’s ruling on the matter I believe the judge is exercising his/her authority and making an authentic choice.
